1. Overview
This promotional offer is sponsored by [Agency Name] (“Agency”). By participating in this giveaway, you (“Participant”) agree to be bound by these Terms and Conditions and the laws of your state of residence.
2. Eligibility
- Age: Participants must be 18 years of age or older.
- State Residency: This offer is only valid for legal residents of GA, FL, NC, MI, KS, OH, TX, VA, SC, TN, and MD.
- Exclusions: Employees of the Agency, its affiliates, and their immediate family members are not eligible.
3. No Purchase Necessary (Anti-Inducement Compliance)
- No Contingency: In accordance with state insurance laws, receipt of any gift card or promotional item is not contingent upon the purchase of an insurance policy, the renewal of a policy, or the receipt of an insurance quote.
- Equal Opportunity: Participation is open to the general public. No person is required to apply for insurance or refer others to the Agency to receive a promotional item.
4. State-Specific Prize Limits
Prizes will not exceed the maximum aggregate value allowed by state law in a 12-month period (to a single person).
- Up to $100: Georgia, Florida, North Carolina, Michigan, Kansas, and Ohio.
- Up to $25: Texas, Virginia, South Carolina, Tennessee, and Maryland.
- Note: In South Carolina, any physical promotional merchandise must have the Agency’s name or logo permanently printed on the item.
5. Gift Card Restrictions
- Non-Cash: Gift cards are provided as store-specific or merchant-specific cards and are not redeemable for cash, except where required by law.
- No Cash Equivalents: Per regulatory guidelines, general-purpose prepaid debit cards (e.g., Visa, Mastercard) may be substituted with specific merchant gift cards to comply with state “cash-equivalent” prohibitions.
- Expiration: Use of the gift card constitutes acceptance of the issuer’s terms. The Agency is not responsible for lost or stolen cards.
6. Referral Programs
If this giveaway is part of a referral program, please note that no referral fee or gift may be paid to an unlicensed person if that payment is dependent on the referral resulting in the purchase of an insurance product.
7. Limitation of Liability
To the extent permitted by law, the Agency shall not be liable for any damages arising out of participation in this promotion or the use of any prize awarded.
8. Privacy
Information collected from Participants is used solely for the purpose of administering this promotion and will not be sold to third parties.
